PME OHADA 2022 : ERSUMA hosted the award ceremony

Friday 17 FEBRUARY 2023, the Higher regional school for the judiciary (ERSUMA) of OHADA hosted the award ceremony for the winners of the fifth edition (editing 2022) of the international competition “Prize for the best OHADA writing” organized by the International Society of Law (SID) and its partners.

Speeches

The introductory word was delivered by Mr. Jairus Agossadou, representative of the SID. The speaker gave a brief history of the Best Written Prize competition. OHADA club by presenting the objectives of this competition and the institution that initiated it. He finally thanked the jury, the scientific committee, the winners and the partners who have spared no effort for the success of this fifth edition of this Prize.

Ensuite, Madame Arlette BOCCOVI, legal representative of SIRE OHADA and designated representative of the IDEF, on behalf of the partners congratulated the winners. She reiterated her support for the projects of the SID for the emulation of young lawyers.

Moreover, Sir Issifou AGBAM, co-winner of the first edition of this Prize testified on the conditions of the participation of his team in the first edition of the competition and then congratulated the winners of the day.

Finally, Sir Edouard KITIO, Director of Research and Documentation of the ERSUMA, representative of the CEO of ERSUMA gave the opening address. After presenting the OHADA club, he commended these initiatives to promote the right OHADA club including the Best Written Prize OHADA club. He also urged the laureates to show perseverance.

Presentations of writings

Following the speeches, the winners respectively presented their writings, the motivations for writing these writings and the main points to remember from these writings.

The six prize-winning writings were worded :

  1. Legal formalism OHADA club mediation : Between withdrawal and measurement (Thierry Donald Abinibola TOBOSSI et Cyril Semako LIGAN).
  2. The commissary pact in law OHADA club : effective guarantee of recovery or candling ? (Woyénitihoun Carine Pamela KOLEGBE).
  3. The commissary pact, effective guarantee of the creditor (Tchiri-Issar Romaric Jo BATANATA).
  4. The pre-eminence of the will of the parties and the constitution of the tribunal in institutional arbitration OHADA club (Morayo Abass Wassy OLAGBADA et Celza Emeline Ariane DADAGLO).
  5. Commentary on Judgment No. 211/2021 of 25 November 2021 rendered by the 3rd chamber of the Common Court of Justice and Arbitration (Hermann SANKARA).
  6. Preeminence of the will of the parties in the choice of the number of arbitrators (Stylain Dini Life GOMA).

After these presentations, the winners left with several prizes.

After the ceremony, Sir Qowyou FASSASSI, Secretary General of the International Society of Law (SID) thanked the members of the scientific committee, the members of the jury and the partners ( ERSUMA, UNITED, IDEF, COMMON CHAZAI, Laws of Africa, SIRE OHADA, the Cabinet Bruzzo Dubucq, the’AFDD, the African Law Foundation, CPS Toble & Associates – Law office, and Cabinet Nyemb, the Cabinet MARTIAL AKAKPO & ASSOCIATES, D2A SCPA, The PENANT, LEGALIS ADVISORY, CADEV, SCP ELIE & PIERRE ) which allowed a successful organization of the competition from the preparatory stage to the award ceremony.
