Building on the bright success of the 6ᵉ edition of the Prix for Best Writing Ohada which had been baptized Prix Modi Koko in tribute to Professor Henri Désiré Modi Koko Bebey, The International Organizing Committee enthusiastically announces the official launch of the 7ᵉ edition of this prestigious international legal competition.
Created in 2018 with the support of major partners, The aim of the competition is to promote scientific reflection on OHADA law. This initiative offers young researchers a unique opportunity to contribute to the systematization and the evolution of OHADA law, continuously confronted with growing challenges. Participants will be invited to produce an in -depth analysis either on a proposed theme, either on a selected court decision.
The 7e edition marks a significant advance with the participation of the Free University of Brussels (ULB), in particular its center of private law which integrates the bodies of the competition and intervenes as one of the partners of the competition, thus strengthening its academic and international influence.
PRESENTATION :
FROM “AWARD FOR BEST WRITING OHADA” TO “AWARD FOR BEST LEGAL WRITING”
Previously called “OHADA Best Article Prize” (PMA – OHADA) until the third edition, the introduction of the Court Decision Commentary exercise encouraged a change in the name of the competition to “ OHADA Best Written Prize » (PME-OHADA).
This prize was an international competition initiated in 2018 with the support of UNIDA and Ohada.com. Through the editions, other partners supported it.
Initially intended for national researchers, the competition became international from the first edition, given the growing interest of nationals of several OHADA member and non-member states.
Given the experience acquired and its growing success over the years ; the involvement of jurists from the four corners of the globe and requests on complex issues related to the crisis of constitutionalism, climate challenges and other environmental issues, the future of international law and its principles in the light of contemporary crises, the International Law Society has decided in accordance with its desire to act effectively in legal commerce from a multidisciplinary perspective, to rename the competition to “ Prize for Best Legal Writing » (PEEJ). So, as part of the launch of the 6th edition, the competition will now include three law disciplines namely : OHADA law, intellectual property law and public law with the drafting of the draft universal declaration of environmental rights in perspective.
This exercise aims to encourage researchers to participate in the thinking and systematization of law, constantly facing new challenges. It also aims to highlight quality scientific work in the perspective of a scientific work or a special issue dedicated to an empirical problem of proven interest..
FOCUS ON THE RESULTS OF PREVIOUS EDITIONS
To his credit, Six editions of the Prize were organized to 2018 nowadays :
1- The first saw the successful participation of the article entitled : “Ethics in OHADA arbitration : study in the light of the new Uniform Act relating to arbitration law and the new Arbitration Rules of the CCJA », written by : Komlanvi AGBAM (University of Dijon) and Hodabalo Bidjaréou Mouzou (Kara University)
2- The second rewarded the article entitled “Mediation or the Blivet of OHADA law”, written by: Yacouba-Sylla KOITA, student at the University of Toulon.
3- The Jury of the third edition declared the winner the article entitled : “The crisis of normativity in OHADA consumer protection”, written by : Qowyou FASSASSI, Lawyer-researcher, Alumni of the UNESCO Chair of Human Rights and Democracy at the University of Abomey-Calavi.
4- In Paris (France) and in Cotonou (Benign) were rewarded as part of the fourth edition the article entitled « From green code to green standards : what model of CSR integration in OHADA law for an ever-increasing investment rate ? », written by : TRAORÉ Douty Abib, student at the University of Paris Dauphine-PSL.
and the commentary entitled “The end of public companies and their immunity under OHADA law”, written by : AHOUNOU Minassa Samuel Ayodélé, Lawyer.
5- The Jury of the fifth edition chaired by the Professor Samuel Aristide BADJI and under the scientific coordination of Dean Henry Wishes MODI Coconut Baby was declared the winner the article entitled “ The formalism in OHADA law of mediation : between withdrawal and measurement » by co-authors Thierry Donald Abinibola TOBOSSI and Cyrille Sèmako LIGAN and the decision commentary entitled “The preeminence of the will of the parties and the constitution of the tribunal in OHADA institutional arbitration”, co-authors Morayo Abass Wassy OLAGBADA and Celza Ariane Emeline DADAGLO.
6- The jury of the sixth edition that presided over Madame Arlette Boccovi Essivi and under the scientific coordination of Pr. Joseph FIFAMIN DJOGBENOU declared the winner the article entitled the article "The contractualization of OHADA commercial companies law : A youthful cure to the taste of unfinished " of Mr. Cheikh Saad Bouh Thiam, and the decision -making commentary entitled "Closure deemed to be contradictory of current account : The CCJA maintains the course " of Mr. Fernand JOEMOU PATIO. Were also rewarded in order of merit : "The financing of companies on a low -budget in OHADA law in terms of the contractualization of the law of commercial companies" of Mr. Mahougbé Odric Houndekon; "The autonomy of the will in the face of the imperativeness of OHADA law of commercial companies : the articulation in question " of Mr. Mahunan Rodrigue Davakan and "The competence of the arbitrator to resolve private conflicts in OHADA law : reality or effectiveness ? » de Monsieur DALLE BETOME.
PERSPECTIVES
Given the many challenges facing the International Law Society, several disciplines will make their entry over the years alongside OHADA law, intellectual property law and public law, to respond effectively to the contemporary debate on empirical issues of proven interest under the legal prism.
In effect, these initiatives aim to realize the ambition of the SID to participate in the global effort aimed at laying the foundations for international emulation in the promotion of a right.
