Thirtieth anniversary of OHADA : uniform African business law at the heart of discussions at the Catholic University of Lyon

Under the leadership of academics Gérard NGOUMTSA ANOU, Professor at the University of Grenoble Alpes and Louis-Daniel MUKA TSHIBENDE, Lecturer at the Catholic University of Lyon, experts in uniform African business law gathered for a scientific conference on 23 November 2023 at the Catholic University of Lyon (UCLy). For the latter, it was a matter of looking at thirty years of application of uniform African business law. (OHADA club).

In effect, this conference appears as one of the initiatives to popularize OHADA law during this period of commemoration of the thirtieth anniversary of OHADA.

After the welcome words from the UCLy rectoral authorities, Professor Gérard NGOUMTSA ANOU spoke to the audience about the program of the event both in its density and in its originality.

The thirty-year application of OHADA law was addressed through four round tables. These round tables were structured respectively around the themes of guarantees of application of OHADA law, the contribution of external standards to the application of OHADA law, the effectiveness of the application of OHADA law and the challenges to be met for better application of OHADA law.

Several specialists in OHADA law, in their capacity as practitioner and/or theoretician, took turns presenting the quintessence of their communication and answering questions from participants in person and online.

Among the speakers, we can cite the teachers, academics and practitioners Alex TJOUEN, Thierry GRANIER, Gérard BLANC, Jean-Jacques ANSAULT, Gérard LATEST NEWS, Roger MASSAMBA, Samuel-Jacques PRIMO-ESSAWE, Sylvie BATAKOU, Aline MBENOUN-NGOUE, Didier PRINCE AGBODJAN, Falilou DIOP, Charlemagne DAGBEDJI, Louis-Daniel, Stéphanie KWEMO, Jimmy KODO, Aziber DIDOT-SEÏD ALGADI, Benjamin BEKONO OBAMA et Thomas KENDRA.

Throughout this conference, the speakers have, with hindsight and the distance they maintain with the OHADA ecosystem, analyzed the ins and outs of uniform African business law.

This conference also saw the participation of the new Permanent Secretary of OHADA, Professor Mayatta Ndiaye MBAYE. During the closing speech, the latter praised the vision of popularizing OHADA law of the initiators of the conference. He affirmed that he was aware of the many expectations of those involved in OHADA law., even if certain expectations exceed the scope defined by the Treaty of Port-Louis as revised in Quebec. He also highlighted the possible prospects, including the revision of the Treaty as well as the modernization of the arbitration institution of the Common Court of Justice and Arbitration of OHADA (CCJA).

This conference was supported by the rectoral authorities of the Catholic University of Lyon, represented by Valérie AUBOURG., Vice rector in charge of research and Marjolaine MONOT-FOULETIER, head of the legal sciences research center, political and social.

The participants of this conference left more seasoned on this African uniform law which is changing and faced with new challenges like any social institution..
